Terms of Service

1. Agreement

By accessing or using Chairside (“we,” “us,” or “our”), including our website and any related mobile or web applications (together, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. The Service

Chairside provides AI image tools that help you preview hairstyles, haircut details, fades, tapers, line-ups, and related edits using photos and prompts you provide. We may change, suspend, or discontinue features with reasonable notice where practicable.

3. Eligibility

You must be able to form a binding contract in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Accounts

You are responsible for your account credentials and for activity under your account. Notify us promptly at chairsidestudio@gmail.com if you suspect unauthorized access.

5. Your content

You retain ownership of content you submit (“User Content”), including uploaded photos, prompts, and saved generated outputs. You grant us a limited license to host, process, back up, transform, and display User Content solely to operate and improve the Service, including AI generation, image editing, security, and abuse prevention, as further described in our Privacy Policy.

You represent that you have the rights needed to submit User Content and that your submission does not violate applicable law or third-party rights.

6. Acceptable use

You agree not to misuse the Service, including by attempting to probe, scan, or test vulnerabilities without authorization; interfering with the Service; infringing intellectual property; uploading malware; harassing others; impersonating people without permission; creating unlawful, abusive, deceptive, or non-consensual images; or using the Service for unlawful purposes.

7. Subscriptions and fees

Certain features, including Chairside Pro, HD output, priority processing, or additional generations, may require payment. Fees, renewal terms, cancellation rights, and fair-use limits are presented at purchase and may be processed by third-party payment providers. Taxes may apply. If a payment fails, we may suspend paid features until resolved.

8. Third-party services

The Service may integrate third-party services (for example, authentication, analytics, billing, hosting, storage, or AI model providers). Their use is subject to those providers’ terms and privacy policies.

9. Disclaimers

The Service is provided “as is” and “as available.” AI-generated haircut previews are illustrative and may not exactly reflect real-world hair texture, density, color, styling, barber technique, lighting, or final results. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising from course of dealing or usage.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, resulting from your use of the Service.

Our aggregate liability for claims arising from the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim or (b) fifty U.S. dollars (USD $50), unless applicable law requires otherwise.

11. Indemnity

You will defend and indemnify us against claims arising from your User Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights, subject to applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if we must comply with law, or if we discontinue the Service. Provisions that by their nature should survive will survive termination.

13. Changes

We may update these Terms by posting a revised version and updating the effective date. Continued use after the effective date constitutes acceptance of the revised Terms if permitted by law. If you do not agree, stop using the Service.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, unless a different governing law is required where you live.
